INCIDENT FLOW

Incident Flow is operated by Nowetner Manufacturing ("we", "us", "the seller"). When you create an account or purchase a subscription, you are contracting with Nowetner Manufacturing.
By creating an account or continuing to use Incident Flow, you agree to these Terms & Conditions. If you use the service on behalf of a fire department or other organization, you confirm you have authority to bind that organization. If you do not agree, do not use the service.
Incident Flow lets fire crews fill out ICS forms and vehicle inspections from the field, save drafts, submit forms for supervisor review, export official-layout PDFs, and store submissions in a shared department space. Departments purchase seat-based subscriptions for their members.
You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Department supervisors are responsible for managing their department's members and invite codes.
You must not misuse the service. This includes:
We retain all ownership of the service and its intellectual property, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your department's subscription. You retain ownership of the content you enter; you grant us a limited license to host and process that content solely to provide the service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms). Subscriptions renew automatically until cancelled. Seat counts can be adjusted by department supervisors; changes are billed per the plan terms shown at checkout.
We work to keep Incident Flow available and reliable, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Incident Flow is a documentation tool; it is not a substitute for incident command judgment, training, or official agency procedures.
We may suspend or terminate access to the service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, departments may request an export of their stored submissions for a limited window before data is deleted.
To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months before the claim, and we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it. You indemnify us against claims arising from your content, unlawful use, or violation of these terms.
These terms are governed by the laws of the State of Texas, and disputes will be handled in the courts of Texas. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control.
